We recommend you read these Terms and Conditions in full prior to you making a purchase from our website. We also recommend you immediately inspect any goods that we deliver to you or that you collect from one of our stores to ensure you are completely satisfied. 1. Definitions:

Your purchase of goods from www.fitzfurnitures.com (“website”) is subject to this Returns and Refund Policy. If you do not accept these Terms, you must refrain from using this website or making a purchase from this website. www.fitzfurnitures.com is a website operated by Fitzfurnitures Limited (“us”, “our”, “we”, “Fitzfurnitures”). We are a limited liability company registered in Ireland under company number xxx and have our registered office at xxx. Our VAT number is xxx. The goods and services described in this website are available from Fitzfurnitures only. You and Fitzfurnitures may enter into a sale contract for the sale and supply of goods and/or services described in this website, by you making an offer to Fitzfurnitures via the website, to purchase the goods and services at the specified price, subject to the Refund Policy terms. In these terms: (a)  “you”, “user”, “member”, and “guest” means anyone who visits and/or uses this website. (b)  reference to a “third party” in these Terms includes a reference to any agent or contractor of Fitzfurnitures, or of any of its related entities, and any person engaged by any of them, in the creation, provision or maintenance of the website or in the fulfilment of orders made through the website, and includes any of them. (c)  a reference to the “website” means www.fitzfurnitures.com (d)  “Order” means an offer made by you in response to an invitation to treat made by Fitzfurnitures via the website. By accessing and/or using the website, you accept these terms and agree to be bound by them, and an agreement is formed between us and you.

2. Membership:

You may access and/or use the website as a guest or as a member. To become a member of the website, you must provide your name and address, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details we may not be able to activate your membership or supply goods or services to you. You agree to keep your membership details current at all times by accessing your account via the website or by contacting our Customer Care Team at customercare@fitzfurnitures.com. You will receive an email from us as soon as practicable after you create your membership account. We only permit one registration per email address. You must not use another member’s account without permission. You must keep your password secure as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorised use of your password or account. If you forget your password you may click on the relevant link located on the website and we will email you a new password, or you may contact our Customer Care Team at customercare@fitzfurnitures.com. We reserve the right to terminate a member’s account without notice for any reason whatsoever including without limitation, if you have breached or we suspect you have breached these terms and conditions.

3. Legal Capacity:

You must be eighteen (18) years of age or over to register as a member of the website or purchase goods or services from the website. Any Order and/or purchase made by you using this website is an acknowledgement by you that: (a)  you are over the age of eighteen (18) years, (b)  you accept these terms and conditions, (c)  you agree that you have entered into a legal relationship with Fitzfurniture governed by these terms and conditions, (d)  these terms and conditions, together with your Order, constitute the entire contract between you and Fitzfurniture for the supply of goods or services. Fitzfurniture reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an Order to be placed, for any loss or damage of any kind Fitzfurniture may suffer as a result of a transaction entered into by a minor.

4. Orders:

We recommend you carefully preview any proposed Orders before adding them to your shopping basket and proceeding with your Order. Representations of goods or services for sale made by Fitzfurniture via the website do not constitute an offer to sell but an invitation to treat. You and Fitzfurniture may enter into a contract for the sale and supply of goods or services by you making an offer via the website to purchase goods at the price advertised on the website by: (a)  placing an electronic Order for the goods or services using the website, (b)  you confirming the Order details in accordance with the procedure on the website, (c)  you making payment in full (plus any applicable delivery and handling charges) on the website, and (d)  the acceptance of that offer by Fitzfurniture. When entering into a sale contract via the website, you will be taken to have communicated your offer to purchase the good(s) or services only when: (a)  any and all requirements set out in these Terms have been met, (b)  the electronic instruction containing the offer from you enters and is recorded in our database, (c)  a record is created and stored in our database, (d)  Fitzfurnitures receives in its account full payment from you for the goods or services (including any applicable delivery and handling charges) and confirmation of that payment is received by our database. You acknowledge that: (a)  the transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by Fitzfurnitures for reasons beyond either parties’ reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications failure, or the omission or failure of third party website providers or systems, (b)  to the fullest extent permitted by law, Fitzfurnitures is not liable to you in any way for any loss or damage of any kind, however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through the website, or any failure to receive an electronic instruction for whatever reason, (c) Fitzfurnitures may act on and process all completed electronic instructions transmitted or issued through the website without further consent from or reference to you, (d)  Fitzfurnitures may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions. You will receive an email from Fitzfurnitures as soon as practicable after you have confirmed your Order and made payment. If you have any questions regarding your Order you may contact our Customer Service Team at customercare@fitzfurnitures.com. Please note this email does not constitute acceptance of your Order by us but merely confirms our receipt of your Order. If your Order is not accepted by Fitzfurnitures, we will notify you by telephone or email and arrange for a full refund of any payment made by you to be processed. Fitzfurnitures may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, goods or services on the website, or an error of any kind in or relating to your Order. Any representations made at any time about stock availabilities are accurate to the last known stock level and are subject to change. If Fitzfurnitures cannot supply particular goods, we will notify you by telephone or email as soon as possible. Fitzfurnitures will be deemed to have accepted your Order on the first to occur of issue to you of a tax invoice for the sale and the fulfilment of your Order. With regard to any Order placed by you for any customised goods (including without limitation furniture made to/incorporating a particular design, specification, colour, configuration, pattern or fabric) Fitzfurnitures will e-mail you a notice of acceptance following confirmation of receipt of your Order at which point the customised goods shall be ordered by us from our suppliers. Upon the sending to you of the notice of acceptance, Fitzfurnitures shall be deemed to have accepted your offer, following which no cancellation of your Order by you shall be permitted and no refund shall be made by us in respect of such goods.

5. Gift Cards:

Fitzfurnitures Gift cards are redeemable across all of our stores, including our online store. The special terms and conditions pertaining to Gift cards are as follows: the Gift cards are (a) issued by Fitzfurnitures Ltd, (b) not redeemable for cash, (c)  void if altered or defaced, (d)  redeemable for goods and/or services online or at any Fitzfurnitures store within the Republic of Ireland, (e) not replaced or honoured if damaged, lost, stolen or the subject of fraudulent presentation, (f) valid for 2 years from the date of purchase, (g) not limited to spending the full amount in one transaction and there is no limit on the number of Gift Cards that can be used in a single transaction, (h) limited in respect of redeeming more than 5 gift cards in a single transaction online, (h)  amendable in terms of the name on the Gift Card.

6. Price:

All prices shown are in Euros and include VAT where applicable. Prices may not include delivery and handling charges. Prices are valid until amended or removed from the website and are subject to change at any time. Each published saving in respect of goods or services is by reference to the lower of the recommended retail price of the manufacturer or the normal ticketed price of Fitzfurnitures. Images of goods shown without any advertised price beside that image are not offered for sale. Unless otherwise stated, accessories shown in any image of goods are not included in the price. We reserve the right to correct any errors published on the website at any time. Errors in pricing are subject to correction with your approval. If you do not approve Fitzfurnitures reserves the right to cancel the sale. Please confirm the prices at point of purchase.

7. Payment:

all payments must be made in full prior to delivery, including any applicable delivery or handling charges. Payments must be made via the secure payment gateway facilities accessible via the website and will be subject to any additional terms and conditions of these providers.

8. Supply and Delivery:

Subject to your compliance with these terms and conditions, and the acceptance of your Order by Fitzfurnitures, Fitzfurnitures will sell and supply the goods or services to you as shown on your Order confirmation. If the goods that you have ordered are in stock, Fitzfurnitures will endeavour to dispatch items within seven (7) to twenty one (21)  business days. Goods may not be available for immediate delivery. Fitzfurnitures will endeavour to deliver your order to you within twenty-eight (28) business days of the date you place your order, except if the order is for any customised goods or for a large furniture or bedding item. Items of customised goods or large furniture or bedding items which are not held in stock will be required to be ordered. You agree that your order for customised goods or a large furniture or bedding item may take up to sixteen (16) weeks to be delivered to you from the date you placed your order. This timeframe is the average manufacturing lead time required by suppliers. Fitzfurnitures will contact you on receipt of your order to notify you of the indicative delivery date. When you complete your Order you will be prompted to select whether you wish to collect your Order from a Fitzfurnitures Store or to have the Order delivered to an address specified by you. Other than in respect of Orders for furniture and any customised goods, if Fitzfurnitures gives you notice that it will be unable to deliver your Order within twenty eight (28) business days of receipt of your Order, due to lack of stock, you may cancel your Order without charge, and Fitzfurnitures will arrange for a full refund of any payment made by you to be processed. Delivery dates are estimates only and we are unable to accept any liability for failure to deliver the goods within the specified time resulting from shipment/delivery delays from our suppliers. If there is no one available to accept delivery on the pre-arranged delivery date, you will be charged for storage, transport and re-delivery costs. Should you arrange your own delivery or collection then the goods become your responsibility upon collection from Fitzfurnitures.

9. Delivery by Courier:

This clause applies where you select to have your goods delivered to a specified address. The delivery address must be an address within Ireland and cannot be a freight forwarding location. Deliveries cannot be made to PO Boxes. On acceptance of your Order by Fitzfurnitures, your Order will be dispatched to your specified delivery address generally within seven (7) business days, subject to the other provisions of these terms and conditions. If you Order large or bulky items, Fitzfurnitures will contact you by telephone or email to arrange with you a suitable time for delivery. You will be required to be available in person to accept delivery of your Order. If you wish to change the delivery date or delivery address you must contact our Customer Care Team at customercare@fitzfurnitures.com. Please have your Order number to hand as shown on the email confirmation of your Order. Fitzfurnitures will use its reasonable endeavors to deliver your Order within any stated timeframes for dispatch, however Fitzfurnitures does not warrant that these timeframes will always be met, as many factors may affect these timeframes. Although we are unable to give a specific time of day for deliveries, we will try to accommodate you where possible. You will be contacted to schedule your delivery on a given day and the driver will contact you one hour in advance on the day of delivery. In the event that a scheduled delivery is cancelled by you or a redelivery must take place, a fee will apply.  As we offer a delivery service on all items, a delivery charge applies to all deliveries. Occasionally Fitzfurniture will engage the use of independent transport companies to carry out home deliveries and the service is fulfilled by a trained one- or two-man crew. Any claims relating to personal property or effects being damaged or soiled during the course of delivery should be reported directly to your store of purchase within 3 days and all claims will be forwarded to the relevant transport company to be processed. You must advise at the time you place your Order via the website or later when you discuss delivery with Fitzfurnitures, of any difficulties that may be involved in the delivery (such as stairs or narrow entries). If you do not state the situation correctly and on arrival the delivery contractor deems it to be a difficult location you will be liable for any extra charges including redelivery fees and the cost of an extra person to assist.  It is your responsibility to ensure that the items that have been ordered will fit into the room for which they are intended, that they will fit through all access points to the room and that there is sufficient access for a large delivery truck to reach the delivery address. Fees for redelivery may apply. The delivery crew may not attempt delivery if there are health and safety issues or where damage to your home may result. They may not remove doors or windows. Road access to the delivery address must be suitable and adequate for the delivery vehicle so that unloading can be carried out conveniently without obstruction or damage. All doorways, hallways, elevators, and points of access in your property must be measured by you to ensure that they are adequate for the size of the goods being delivered. If the delivery team have difficulty placing an item in the area of your choosing due to limitations such as narrow halls, stairways, corners or ceiling heights, the items will be placed in another area of your home. If you insist that the delivery team manoeuvre an item in a restricted area, you will be responsible for any resulting damages to the furniture and the premises. Prior to delivery, you are responsible to ensure that all access routes, flooring and door frames are protected. Fitzfurnitures will not accept responsibility for any damage caused where floor covering protection was not used. Storage Items that are in stock and/or are ready for delivery will be held in storage for a maximum period of 4 weeks. Storage fees will apply after this period. A charge of €25.00 per week is applicable to all items held in storage. Fitfurnitures cannot and will not accept responsibility for delivery failures or delays by our third party delivery contractor. You are required to inspect your goods when you take delivery of them. You will be required to note any damage on the delivery documentation which is presented to you by the carrier for signature. In all other cases you will be required to notify us in writing of any damage on delivery or shortages within three (3) days of delivery. We will not be liable for any damage on delivery to any of the goods unless we are notified within the time period specified above.

10. Orders for Collection:

This clause applies where you select to collect your order from a Fitzfurnitures store. If items cannot be loaded safely or without damage into the pickup vehicle, our warehouse teams may politely decline to load onto vehicle. For goods collected, transport will be entirely at your risk. Please inspect all your new furniture at the time of pick-up. Fitzfurniture cannot be held responsible for any transit damage caused thereafter. If there are any items that do not meet your approval, inform the warehouse team immediately. If you select to collect your goods from a Fitzfurnitures store, a representative of the relevant Fitzfurnitures store will contact you by telephone or email to notify you when the order is available for collection. When collecting your order from the store, you must bring each of the following items with you: (a) a valid form of photo identification, (b) a copy of the order confirmation, (c) the credit/debit card used to complete the purchase. Orders for collection at a Fitzfurnitures store must be collected within fourteen (14) days of the relevant Fitzfurnitures store giving you notice by telephone or by email that your order is available for collection. If your order is not collected within this time, the relevant Fitzfurnitures store has the right to allocate those goods to another customer and reorder the goods for you.

11. Cancellations for Purchases Made Instore:

Cancellations of instore purchases are accepted within 48 hours of order. Cancellations after 48 hours will result in the loss of deposit. Cancellations are not permitted on custom orders where an item has been ordered to your exact specifications or on any non-standard combination order.

12. Title and Risk in Goods:

  1. Title and risk in goods pass to you on delivery or collection, as the case may be.

13. Payment and Credit Card Fraud:

To the fullest extent permitted by law, Fitfurnitures and its related entities will not be responsible for any damages or consequential losses of any kind (whether direct or indirect) suffered by a user where a credit/debit card, PayPal account or other payment method is fraudulently used or is used in an unauthorised or improper manner.

14. Disclaimer and Indemnity:

To the fullest extent permitted by law (and without limitation to any other provision of these terms and conditions), Fitzfurnitures, and each of its related entities, exclude all liability to you or anyone else for any and all loss or damage of any kind (however caused or arising) relating in any way to the website (or any goods or services purchased on the website) including, but not limited to, loss or damage you might suffer as a result of: (a)  errors, mistakes or inaccuracies on the website, (b)  you acting, or failing to act, on any information contained on or referred to on the website and/or any linked website,  (c)  personal injury or property damage of any kind resulting from your access or use of the website, (d)  any unauthorised access to or use of the websites secure servers, (e)  any interruption or cessation of transmission to or from the website, (f)  any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through the website by any third party, (g)  the quality or fitness for any purpose of any linked sites. Without limitation to the foregoing, except as expressly provided in these terms and conditions and to the fullest extent allowed by the law, Fitzfurnitures and its third parties will not be liable for any direct, indirect, special, incidental or consequential damages arising out of your access to or use of the website or any goods or services purchased on it. Except as expressly stated in these terms and conditions, we do not give any representation, warranties or undertakings in relation to the goods or services on the website. Any representation, condition or warranty which might be incorporated into these terms by statute, common law, the law of equity or otherwise is excluded to the fullest extent permitted by law. In particular,  we will not be responsible for ensuring that any goods or services are suitable for your purposes. You will at all times indemnify, and keep indemnified, Fitzfurnitures, and each of its related entities, including their directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by any of them arising from any claim, demand, suit, action or proceeding by any person against you or them where such loss or liability arose out of, in connection with or in respect of your conduct or any breach of these Terms. This clause is not intended to exclude your rights under the Sale of Goods and Supply of Services Act 1980.

15. Defective Products:

If any goods ordered by you arrives damaged or is not of acceptable quality you may have: (a)  rights under our Returns and Refund Ploicy, (b)  legal rights and remedies in Ireland under the Sale of Goods and Supply of Services Act 1980 or any other applicable legislation, (c)  to have the goods repaired or replaced or to receive a refund of the price paid by you for the goods. If your Order arrives damaged, please contact our Customer Care Team at customercare@fitzfurnitures.com.

16. Quality Control:

Please be advised that our warehouse teams will sometimes quality check items by opening the packaging to examine the product before it is dispatched to the delivery company. This is done to ensure that only furniture of the highest quality is delivered to your home.

17. Mattress Care and Maintenance:

Before using the product, open all packaging in a well-ventilated room and leave uncovered for at least 24 hours. Due to materials used during production, there may be an odour from your mattress for a number of weeks. We would strongly recommend the use of a mattress protector on all mattresses. Occasionally vacuum the surface of your mattress to remove dust and let your mattress air regularly. Always follow your manufacturer’s cleaning and care label instructions. If you spill something on your mattress make sure you extract as much of the spill as possible – mattresses don’t dry out easily. You can stand it on its side to minimise the penetration of moisture and allow it to air dry away from direct heat. Body Signatures are the impressions the body makes on the surface or comfort layers of the mattress where the main weight of the body has been lying. Body Signatures are normal and indicate that the mattress is adapting and conforming to the body shape. Generally, a depth between 25-35mm is normal within the first 12 months. If the depth of the depression is greater than 40mm, further investigation may be required. These values may vary for plush mattresses due to the thickness of the comfort layers. The more plush the mattress, the more noticeable the Body Signature may be. Please refer to the manufacturer’s instructions in relation to rotation or turning of the mattress. Some mattresses need to be flipped while other mattresses need to be rotated head to toe. Ensure not to bend or roll your mattress. Bending or rolling your mattress will damage the spring unit. Sitting on the edge of your mattress for long periods can also affect its shape. Mattresses should be used on an appropriate supportive base or frame. Avoid placing a board between your mattress and your box spring – it can interfere with the supporting function of the box spring. Check that legs and castors are tightened fully from time to time. Issues relating to comfort cannot be attributed to a manufacturing fault.

18. BEDROOM FURNITURE CARE AND MAINTENANCE:

To clean, simply dust. Wipe away any stains with a moist cloth, followed immediately with a dry cloth to avoid watermarks. However, should you need to remove any heavier stains, please use a neutral detergent, taking care not to over rub – rinse with clean, lukewarm water. We recommend that you avoid placing the bed near radiators. Similarly, direct sunlight may cause some fading. Proper centre supports make a world of difference when it comes to your complete bedding setup. Not only do supports add to the comfort of your mattress, they also prevent damage to your bed. Without them, your mattress will almost certainly start to sag. If you are placing your bed on a wooden/tiled floor we recommend the use of a rubber mat under the feet to prevent them from slipping on the ground. Adjustable centre feet should not touch the ground, there should be a slight gap between the foot and the floor to allow for movement and to avoid it getting bent if the bed moves. Also take care when moving the bed for cleaning that you straighten the centre foot afterwards so that it is offering the correct support. Please refer to the manufacturer’s instructions for full details.

19. Assembly of Furniture:

When opening the box/packaging please do not use a knife or a blade. Having unpacked your furniture, check that it is complete and all parts are present. Ensure all fittings have been removed before disposing of packaging. This should not be left within reach of children as it may be dangerous. For ‘self-assembly’ furniture, read the assembly instructions before starting. Identify the parts of your furniture and follow the assembly sequence. Avoid use of force when assembling parts; be careful not to over tighten fittings during assembly. In order to avoid any damage during assembly, use the appropriate tools and work on a surface covered by carpet or other protective layer. For gluing operations (drawers for example), use the glue provided and leave assembled parts to one side for one hour to allow the glue to dry in a well ventilated area. Please note, the feet for certain products may be found in the zip pocket underneath the suite. Assembly and installation must be done in accordance with our instructions. Failure to follow assembly instructions may result in poor performance of your product and void your warranty. This warranty does not cover any damaged or defective parts that result from incorrect installation and assembly, abuse, negligence or improper use. If instructions are not followed, we decline any liability in the event of damage caused to people or property as a result of incorrect installation. Where assembly instructions specify safety measures (markings for example), they must be complied with, if not, we will under no circumstances be considered liable for any harm that may occur. Where maximum loads are stated, please do not exceed these as this may lead to sub-standard performance, possible damage to the product and even collapse. Installing your furniture Once assembled, position the furniture, ensuring it is level so that doors and drawers open and close properly; Fixing it will facilitate adjustment (hinges or runners). Check the final stability of the furniture. When positioning the furniture please do not drag, items should be lifted by the bottom base. After assembling a table, with the aid of another person, carefully lift the table and turn it over into the upright position. Take care not to put pressure on legs when turning as this may damage the base or joints. Felt pads or gliders should be used under all furniture products. If you need to move your furniture, you must empty it; this will make handling easier and avoid risks of breakage or injury. This does not apply to furniture fitted with casters; emptying the furniture in this case is at your discretion. Note If stated in the assembly instructions, furniture must be fixed to the wall using furniture safety straps and fixing provided.

20. Wood Care and Maintenance

Whether you have an all-wood piece of furniture or a furnishing made of a mix of wood, man-made wood (engineered materials) and wood veneer, you want to protect it from damage, maintain its perfect finish and keep it looking beautiful for years to come. Here are some tips to help you do that. Solid woods may expand and shrink with changes in temperature and humidity. Take care not to place your furniture next to radiators or anywhere that could be subject it to excessive changes in temperature or moisture. Avoid placing furniture directly under windows. We recommend that all kitchenware and beverages should be placed on coasters, mats and hot pads. Clean up spills immediately as liquid left sitting for a long period may cause staining or soak into the product and cause damage. If this happens typically white stains appear and bubbles may appear in the top coat. Please note that furniture may only be covered with an oilcloth for a maximum of 12 hours at a time in order for the wood to breathe. Shelves or drawer boxes should not be overloaded beyond capacity. For drawers that sit directly on the ground, bear in mind that carpet pile will restrict the free movement of drawers. Always use the handles provided to open and close drawers/doors. It is recommended that all self-assembled products should be periodically checked to ensure that all the fittings are secure. Do not over tighten the fittings. To clean, use a duster or lint free cloth regularly. Never use all-purpose chemical/cleaning sprays on your wood furniture. You should not use soap and water on a regular basis as it can stain and damage the wood. Use soap and water sparingly to get rid of hard stains. Dry and buff immediately with a dry cloth to avoid staining. In the event of more stubborn marks, a solution of mild detergent should be used on the cloth. Silicone based polishes should not be used on the wood as they will build up and leave a sticky residue on the surface. Never place hot items such as dishes directly onto a table or surface without using a heat resistant mat or trivet as direct heat will draw out the moisture in the wood. This could leave a ring mark ingrained into the wood. Very hot items such as a saucepan or baking dish should never be placed on a table top, even with a hot pad. Avoid placement of heated electrical equipment, cigarettes, candles etc. on furniture tops and surfaces. Use protective mats and ashtrays. Colour differences in woods are to be expected and knots, shading and grain differences are a natural characteristic and can sometimes be non-uniform in appearance. This is a feature and not a fault of these products. The colour of wood will naturally mellow with age. However, prolonged exposure to direct sunlight may accelerate this process.

21. Glass Furniture:

Tempered glass surfaces offer a high level of safety, as a matter of fact, in case of breakage, the glass will crumble into small fragments. Try to prevent accidental breakages of tempered glass. Do not place hot or cold objects on the surface, and avoid impact with hard or sharp objects. As with wood, use of coasters will protect the surface of your furniture. Take care to avoid sliding rough objects across glass as this can cause permanent scratches to the surface. Clean your glass surfaces regularly using mild soap or non-abrasive glass cleaner. Gently remove excessive dirt and debris rust to avoid scratching glass. Then using a non-abrasive glass cleaner or mild soap and water, wipe surface. Dry immediately with a dry lint free cloth.

22. Marble Furniture:

Marble is a beautiful surface for tabletops, natural variations and veins in the stone are highlighted by polishing. However, because it is porous marble can easily be stained and scratched. To prevent ring marks, place coasters or trivets under glasses and dishes. Use mats or runners beneath hard objects that might scratch the surface and always blot spills up immediately and clean with a damp cloth. Highly acidic substances such as orange juice, coffee, vinegar, wine, tomato products, mustard and many soft drinks may ‘etch’ the surface. This is a chemical reaction that may leave a dull mark. General cleaners not specifically designed for stone are not recommended as they may etch or discolour the surface or scratch the stone. Regular cleaning should be as gentle as possible. Dust the surface once or twice a week with a soft cloth. Wash the marble periodically with a cloth dampened with warm water and, if necessary, a small amount of dishwashing liquid. Remove the soap with another damp cloth. Remember to always wipe the surface of the table dry as regular exposure to moisture can damage the condition of any natural stone.

23. Ceramic Table Care:

Less is best when it comes to cleaning ceramic table tops, which means more time enjoying meals with family and friends and less time worrying about the clean-up later. Just wipe the surface with a damp cloth or sponge and a mild detergent, like the soap you would normally use in the kitchen. Although dirt cannot penetrate into the ceramic material, it is necessary to remove it from the surface in order to prevent the build-up of surface grease and contaminants. Day to day maintenance of ceramic table tops can be performed by simply wiping down using a clean, microfibre cloth and warm, diluted, neutral detergent to remove surface spillages. Spillages of wine, coffee, ketchup, oils and acidic substances such as vinegar should be wiped clean immediately.

24. Sofa Care:

In order to ensure that your sofa gets to you in the best possible condition, we package it well to protect it on its journey to your home. During the journey, crush marks may appear on your sofa but please do not be alarmed, these will naturally work their way out over a few weeks. Fillings may also have flattened and need to be plumped up in the same manner you would regularly ‘dress’ your sofa. When removing the protective wrapping, do not use sharp tools that may damage your sofa covering. The seat cushions on your sofa may appear to be firmer than those you sat on in the showroom, but please be aware that your seat foam will soften with use. Softening of padding and cushions causes light creasing, wrinkling of fabric and slight stretching of the leather which is considered to be normal wear. It helps, especially when you first get your sofa, to remember to rotate your seating pattern. This ensures even wear and helps your cushions last longer. The frame of your sofa is made up of many different components including wooden frames, springs and metal mechanisms. Wood responds to heat, humidity, and other changes of climate by expanding and contracting. Equally, a new recliner mechanism with all of its moving parts will take some time to settle. With this in mind your new sofa might make some noise as the different parts of your furniture react and adjust to its new environment. With time, this will settle and the noise will disappear. As dust and dirt will cause your sofa to wear faster, we recommend vacuuming regularly with an upholstery attachment. Keep furniture out of direct sunlight and at least two feet from heat sources. This will minimize fading of colour and in the case of leather furniture avoid fading and cracking. Dark colours and natural fibres are most susceptible to fading. Note that sun screen and lotions, certain medications and chlorine are harmful to any upholstery and can cause discolouration. Blue jeans can also transfer blue dye to many coverings. If there is a need to move furniture, always remember to lift rather than pull. Dragging can put pressure on joints, zips and stretch/damage upholstery. Avoid sitting on the arms, or edge of furniture as this may cause distortion or damage. Pushing feet against or placing them on the arms may cause damage to the arm or frame. Issues relating to comfort cannot be attributed to a manufacturing fault.

25. Warranty:

Unless otherwise stated, all furniture and bedding products purchased at Fitzfurniture are covered for a period of one year. Extended warranty may be purchased on certain products for further peace of mind. All products are intended for domestic use and we give no guarantees or undertakings in respect of the use of our products for commercial purposes. Our guarantees are limited to goods sold and retained in ROI and used solely in private residences and not in commercial or rental properties. The warranty is void if Fitzfurniture determines that any damage to the furniture was caused by abuse, negligence, accident or if used for purposes other than which it was intended. Visible surface damage such as scratches, nicks, tears, etc. are not covered under this warranty unless reported within the first 3 days of delivery. Warranty does not cover normal wear and tear.

26. Right of Withdrawal:

As per the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, if you wish to return goods you have purchased from our website, you can notify us by submitting a cancellation request or by returning the goods to your local store or contacting us to arrange a courier or collection. While you can inspect the goods, please note the goods must be in their original packaging, they must not have been used and or they must not have been installed. While the item(s) are in your possession you must take reasonable and appropriate care of them. They must be in “as new” condition and returned in their original and undamaged packaging. Refunds will be processed back to the same payment method that was used for the original order and will be issued once the goods have been returned to us. Please be aware that we will refund your delivery cost only if the return is as a result of our error (e.g. faulty product) and that if you wish to return an order due to a change of mind you will be responsible for all delivery costs when returning goods to a store or a warehouse. In addition, a fee may apply, where the item(s) returned have diminished in value through handling the item beyond what is necessary to inspect the features and characteristics of the item(s). Please note that if you wish to return an order due to a change of mind you will be responsible for all transport costs when returning goods to a store or a warehouse. In addition, any refund processed to yourself will be subject to any diminished value of the goods which may arise from the mishandling or misuse of the goods beyond what is necessary to inspect the goods upon you receiving them.

28. Force Majeure:

Fitzfurnitures will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond its reasonable control, including but not limited to, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems, or postal deliveries, or international crises.

29. Governing Law:

The Irish courts will have jurisdiction over any claim arising from, or related to, a visit to our website or any Order placed on the website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms and conditions are governed by Irish law. If you access the website in a jurisdiction other than Ireland, you are responsible for compliance with the laws of that jurisdiction to the extent that they apply. Fitfurnitures makes no representations that the content of the website complies with the laws of any country outside Ireland.

30. Severability:

If any part of these terms and conditions is found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these terms and conditions, and the remaining terms and conditions will remain in force and constitute the agreement between you and Fitfurnitures.

31. Transfer and Assignment:

If Fitzfurnitures merges, sells or otherwise changes control of its business or its website to a third-party, Fitzfurnitures reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that Fitzfurnitures has collected from you and any agreements it has made with you.

32. Waiver:

The failure by Fitzfurnitures to exercise or enforce any right or provision under these terms and conditions will not constitute a waiver of such right or provision. Any waiver of any right or provision under these terms and conditions will only be effective if it is given in writing and signed by Fitzfurnitures.

33. Cooling Off Period:

If you wish to cancel your plan within 14 days of the purchase date of your plan and you have not made a claim, Fitfurnitures will refund the amount you paid for your plan. Claims made for accidental damage are subject to an Admin Fee.

34. European Online Dispute Resolution for Online Purchases:

If you are not happy with your online purchase from Fitzfurnitures, you can email us at customercare@fitzfurnitures.com. The EU Commission also provides an online dispute resolution platform (“ODR Platform”) for disputes regarding items bought online.

35. Miscellaneous:

Should you experience an issue with your furniture items, please contact your store of purchase. You will need your customer invoice to hand. Our representatives will be happy to assist you with any concerns that you may have. Cancellations are not permitted on special order or custom-made items. Any damages to furniture items must be reported to your store of purchase within 3 days of delivery or collection. After 3 days Fitzfurniture is unable to accept reports of damage on delivery or collection. You may be asked to supply photographic evidence to support any claims of damage to furniture items. These terms and conditions exist in addition to and do not affect your statutory rights.
